2. Services Description

tapsite.ai provides an AI-powered platform that allows users to create websites, manage chatboxes for customer service, generate content, and access various other AI-powered tools. Our Services include but are not limited to:

• Website creation and management tools
• AI-powered chatbox creation and customization
• Content generation using AI technology
• Image generation and optimization
• Form building and management (including webinar registrations)
• Analytics and performance tracking

We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice.

3. Account Registration and Token Usage

To access certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

tapsite.ai operates using an AI token system. New users may receive complimentary tokens (such as our 50,000 token welcome offer) upon registration. These tokens are consumed when using various AI features of our platform. Token usage rates vary depending on the specific feature being used.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Responsibilities and Acceptable Use

When using our Services, you agree not to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Use our Services to distribute malware or other harmful code
• Interfere with or disrupt the integrity or performance of our Services
• Attempt to gain unauthorized access to our Services or related systems
• Use our Services to generate, publish, or distribute content that is illegal, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, or otherwise objectionable
• Use our AI tools to generate content that may perpetuate discrimination or violate ethical standards
• Resell, redistribute, or provide third-party access to features or content accessible through our Services without our express permission

We reserve the right to terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

5. Content and Intellectual Property Rights

Your Content: Any content you create, upload, submit, or display on or through our Services is your content ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in connection with providing and improving our Services.

AI-Generated Content: Content generated through our AI tools is subject to specific terms. While you own the end product created with our AI tools, you acknowledge that the underlying AI models and technologies remain the property of tapsite.ai and its licensors.

tapsite.ai Content: All content, features, and functionality of our Services, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, and software, are owned by tapsite.ai, its licensors, or other providers and are protected by copyright, trademark, and other intellectual property laws.

6. Subscription and Payment Terms

tapsite.ai offers both free and paid subscription plans. By selecting a paid subscription, you agree to pay all fees in accordance with the billing terms in effect at the time. Payment obligations are non-cancelable, and fees paid are non-refundable unless otherwise specified.

Token bundles and subscription plans are subject to our current pricing which may change from time to time. We will provide notice of any price changes in advance. Continued use of the Services after a price change constitutes acceptance of the new pricing.

7. Limitation of Liability

To the maximum extent permitted by law, tapsite.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Unauthorized access, use, or alteration of your transmissions or content
• Issues related to AI-generated content, including but not limited to inaccuracies, inappropriate content, or intellectual property concerns

Our liability is limited to the amount you have paid to tapsite.ai in the twelve (12) months preceding the event giving rise to liability.

8. Disclaimers

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our Services will be uninterrupted, secure, or error-free.

While we strive for the highest quality AI-generated content, we do not warrant the accuracy, completeness, or usefulness of content generated through our AI tools. You acknowledge that AI technology has limitations and may sometimes produce unexpected or undesired results.

9. Indemnification

You agree to indemnify, defend, and hold harmless tapsite.ai and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.

10. Modifications to Terms

We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to access or use our Services after revisions become effective, you agree to be bound by the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Indonesia, without regard to its conflict of law provisions.
